This notice explains how we collect personal information about you, how we use it and how you can interact with us about it.  It also explains your rights under data protection law in relation to our processing of your data. 

Privacy Policy Statement Changes

U Consulting may change this privacy policy from time to time.  When such a change is made we will post a revised version online at www.uconsulting.ie.  Changes will be effective from the point at which they are posted.  It is your responsibility to review this privacy policy periodically so you are aware of any changes.  

Please read this notice carefully as it sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.

Who we are

Clarity Management Ltd trading as U Consulting is regulated by the Central Bank of Ireland as an Investment Intermediary under the Investment Intermediaries Act 1995 and as an insurance intermediary under the European Communities (Insurance Mediation) Regulations, 2005.

U Consulting acts as a Broker on behalf of our clients and our principal business is to provide advice and arrange transactions on behalf of clients in relation to life insurance and other forms of protection policies, pensions, savings and investments.

For the purposes of data protection legislation, U Consulting is a Data Controller and Data Processor of the personal information you provide to us when availing of our services.

The information you provide

You provide personal information to us when you apply for a product and service that we provide. Personal information is collected through manual forms and through our website when you contact us.

Purpose

U Consulting processes information that you provide to us for the purposes of:

  • Provide relevant products and services in line with our Terms of Business contract;
  • Identify ways we can improve our products and services;
  • Maintain and monitor products and services provided;
  • Protect both our interests;
  • Meet our legal and regulatory obligations; 
  • Decide and recommend how our products and services might be suitable for you.

We will only use the information you provide for the above purposes. 

Categories

The categories of personal data provided by you and collected by U Consulting for this purpose are:

  • Biographical data – name, address, phone number, email address, gender, family relationships (e.g. spouse, children), date of birth, PPS number.
  • Payment data – If you pay by direct debit or receive payments through electronic funds transfers, we will collect the IBAN, BIC and the name of your bank/building society.
  • Claims data – If you have made a claim we will process details of your medical history, details of services claimed, payments made, details of other insurance that may cover aspects of your claim.
  • Interactions with us – If you interact with us we will record details of those interactions (e.g. phone calls and logs of phone calls, email correspondence and hard copy correspondence). If you make a complaint we will process details in relation to that complaint.
  • Online services – When you interact with us online (by computer, tablet or smartphone), you will often provide personal data to us, which you will be aware of when using the services or for which you give consent. We also automatically collect data about your use of our services, such as the type of device you are using and its IP address, and how you interact with the services. 

In order to process any special categories of personal data provided (e.g. health, religious beliefs, racial, ethnic origin – financial information is not classified as special categories of personal data), it will be necessary that we obtain your explicit consent. 

Legal Basis

To use your information lawfully, we rely on one of more of the following legal bases:

  • Performance of a contract
  • Legal obligation
  • Protecting the vital interests of you or others
  • Public interest
  • Your consent

If you do not provide the information we need, or help us keep it up to date, we may not be able to provide you with our products and services.

Consent

Sometimes we need your consent to use your personal information. For example, we would need your consent for when and how to contact you for the following reason:

  • to send you information of our products and services which may be of interest to you 

You can decide how much direct marketing you want to accept when you apply for new products and services and on our Terms of Business Acceptance Form.

Retention

We hold your information while you are a customer and for a period of time after that. U Consulting will not hold your personal information for any longer than is necessary for the purpose for which it was collected (business requirements) and in accordance with any legal requirement imposed on us (statutory and regulatory obligations).

Security

Records of all personal information are stored in a secure centralised database (including computerised and manual files). All storage facilities are located in Ireland. U Consulting take appropriate security measures against unauthorised access to, or alteration, disclosure or destruction of the data and against their accidental loss or destruction. 

When you contact us to ask about your information, we may ask you to identify yourself. This is to help protect your information.

Your information and third parties

Sometimes, U Consulting may share your personal information with a third party:

  • Service providers – these can include companies that provide IT services (e.g. scanning and uploading letters from customers and hosting data when providing software services). These can also include legal advisors, accountants and consultants. Where our service providers have access to your personal data, we ensure they are subject to appropriate contracts and other safeguards.
  • Regulators – in certain circumstances we are obliged to provide information to a third party to meet any applicable law, regulation or lawful request (e.g. in the investigation of complaints or a criminal offence)
  • Other companies – these would include only companies with who we have a formal business arrangement and where you have provided consent to our sharing your information with them.

If we transfer personal data to a third party or outside the EU we as the data controller will ensure the recipient (processor or another controller) has provided the appropriate safeguards and on condition that enforceable data subject rights and effective legal remedies for you the data subject are available.

U Consulting facilitates you, our clients, rights in line with our data protection policy and the subject access request procedure. This is available on request.

Your rights as a data subject

At any point while we are in possession of or processing your personal data, you have the following rights:

  • Right of access you have the right to request a copy of the information that we hold about you. You may do this by contacting us directly. 
  • Right of rectification you have a right to correct data that we hold about you that is inaccurate or incomplete.
  • Right to be forgotten in certain circumstances you can ask for the data we hold about you to be erased from our records.
  • Right to restriction of processingwhere certain conditions apply you have a right to restrict the processing of your personal information.
  • Right of portability you have the right to have the data we hold about you transferred to another organisation.
  • Right to objectyou have the right to object to certain types of processing such as direct marketing.
  • Right to object to automated processing, including profiling – you have the right to object to the legal effects of automated processing or profiling.
  • Right to judicial review in the event that UConsulting refuses your request under rights of access, we will provide you with a reason as to why and you may appeal this decision. 

Where applicable, if there is a third party involved in the processing of your data, we will notify them of the above requests.

Failure to provide further information

If we are collecting your data for a contract x and you cannot provide this data the consequences of this could mean the contract cannot be completed or details are incorrect.
